A major legal challenge is mounting in the United States against California’s landmark packaging laws, signalling a period of regulatory uncertainty that could reverberate across global packaging supply chains. The National Association of Wholesaler-Distributors, alongside attorneys general from 17 US states, has filed an amended lawsuit seeking to block the enforcement of California’s Extended Producer Responsibility (EPR) law, Senate Bill 54. Crucially, the legal challenge now also targets Senate Bill 343, the state's strict "truth-in-labelling" law which restricts the use of the iconic "chasing arrows" recycling symbol.

Opponents argue that these regulations place an unconstitutional burden on interstate commerce and compel speech by forcing companies to fund recycling programmes and alter packaging designs. SB 54 mandates a 25% reduction in single-use plastic packaging by weight and plastic component count by 2032, whilst SB 343 prohibits the recycling symbol on packaging unless the material meets strict state-defined recycling rate thresholds.

For UK packaging converters and Turkish recyclers, this legal battle is highly significant. Many UK converters export finished packaging to the US market, where California’s standards often become the de facto national benchmark due to the state's economic scale. If SB 343 survives the legal challenge, only materials that are widely collected and processed in practice—such as clear PET and HDPE bottles—will be allowed to carry the recycling symbol. Turkish recyclers exporting post-consumer recycled (PCR) resins, particularly polyolefins like PP and LDPE, must closely monitor these developments. A successful challenge could delay the implementation of these strict standards, whilst a state victory will accelerate the global shift toward rigorous, evidence-based recyclability claims.

The practical takeaway for businesses is to avoid relying on generic "recyclable" claims for US-bound packaging. Converters and material suppliers should audit their product portfolios against California's strict empirical criteria now, rather than waiting for the final court rulings, to ensure long-term compliance and market access.
